Welcome to plexiqa.

These Terms of Use govern your access to and use of plexiqa. Please read them carefully before using the service.

By using plexiqa, creating an account, or signing in, you confirm that you have read, understood, and agree to be bound by these Terms.

If you do not agree to these Terms, please do not use plexiqa.

1. About plexiqa and the operator

plexiqa is an online service designed to support language learning through vocabulary, grammar, exercises, and related learning features.

2. Acceptance of these Terms

By using plexiqa, you agree to these Terms of Use, as well as our Privacy Policy and any other documents expressly referenced in the service.

If you use plexiqa on behalf of an organization or another person, you confirm that you have authority to accept these Terms on their behalf.

3. Who may use plexiqa

You may use plexiqa only if you are legally capable of entering into these Terms under applicable law.

You agree to:

provide accurate and up-to-date information when registering;
not impersonate another person;
keep your account information reasonably up to date;
keep your login credentials secure.

You are responsible for activity carried out through your account, except to the extent otherwise required by applicable law.

4. Account and access to the service

Some plexiqa features may require you to create an account.

You may register using an email address and password, or by using available third-party login methods such as Google.

You must not share your account with others or give access to anyone who is not authorized to use it.

We may temporarily restrict or suspend access to your account if:

this is necessary for the security of the service;
we reasonably believe these Terms have been violated;
there are signs of misuse, fraud, or unauthorized access attempts;
we are required to do so by law.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to use plexiqa for its intended purpose - personal language learning and use of the available service features.

You may use plexiqa to:

create and use a personal account;
study words, topics, and grammar;
complete exercises;
save progress, settings, and learning preferences;
use available personalized and AI-powered features.

6. Prohibited use

When using plexiqa, you must not:

violate applicable law;
use the service for fraud, abuse, or unlawful purposes;
attempt to gain unauthorized access to accounts, data, infrastructure, or systems related to plexiqa;
bypass restrictions, safeguards, or technical protection measures;
interfere with the operation, stability, or availability of plexiqa;
use bots, scripts, scraping, or other automated means of access without our permission;
distribute malware, viruses, or other harmful code;
use the service in a way that overloads infrastructure or disrupts other users;
copy, resell, license, publish, or commercially exploit plexiqa or any part of it without our prior written permission;
use AI-powered features in a way that violates the law, third-party rights, or the normal functioning of the service.

Fair use and abuse prevention

The service is intended for personal learning, exam preparation, and individual language practice. You must use the service in good faith and only within its ordinary educational purpose.

You must not use the service in a way that disrupts the platform, creates excessive load on infrastructure, bypasses technical or commercial restrictions, extracts data from the service, or uses paid or subsidized service resources for an unintended purpose.

Prohibited actions include, in particular:

using bots, scripts, automated tools, parsers, scrapers, or other means of automated access to the service;
creating accounts in bulk or using multiple accounts to bypass limits, trial periods, plan restrictions, or payment rules;
systematically using AI checks, tasks, answers, hints, or other service features for testing, benchmarking, competitive analysis, resale, copying service logic, extracting prompts, scoring logic, learning materials, or other internal platform mechanisms;
sharing an account with third parties, using an account jointly beyond ordinary personal use, or reselling access to the service;
attempting to bypass technical restrictions, usage limits, payment mechanisms, content protection mechanisms, or anti-fraud systems;
actions that may degrade service quality for other users or cause unreasonable costs for the service.

If we reasonably detect signs of such use, we may apply proportionate protective measures. These measures may include temporary rate limiting, a temporary pause on using specific features, additional account verification, cancellation or restriction of suspicious attempts, temporary restriction of access to specific features, or temporary or permanent account blocking.

When choosing a measure, we take into account the nature of the violation, its scale, recurrence, and impact on the service, other users, and paid platform resources. Where practically possible and where this does not create additional security risks for the service, we will notify the user about the applied measure and provide an opportunity to contact support if the user believes the restriction was applied incorrectly.

We may apply protective measures without prior notice where necessary to protect the service, other users, platform security, payment infrastructure, learning materials, AI resources, or the integrity of exam and practice tasks.

7. Intellectual property

plexiqa, including its software, structure, interface, design, branding, logos, interface text, learning materials, collections, databases, and other elements of the service, is owned by us or used by us on a lawful basis.

These Terms do not transfer any ownership rights in plexiqa or its elements to you, other than the limited right to use the service in accordance with these Terms.

You may not use our trademarks, brand elements, content, or other intellectual property without prior permission, unless applicable law allows it.

8. User content and data

You may submit or store data in plexiqa related to your learning, such as answers, selected words, settings, and other materials you add to the service.

To the extent necessary to operate plexiqa, you grant us the right to store, process, display, and use such data for the following purposes:

providing the service features;
saving progress and personalization;
technical support;
improving service quality;
operating AI-powered features where relevant.

You confirm that you have the right to use and provide such data within plexiqa.

9. AI-powered features

plexiqa may include features that use artificial intelligence to generate, adapt, or personalize learning content.

You understand and agree that:

AI-powered features may produce incomplete, inaccurate, or imperfect results;
AI-generated outputs may require your own review and judgment;
AI-powered features are provided as supportive learning tools;
AI-generated outputs do not constitute legal, medical, financial, or other professional advice.

We may change, improve, limit, or discontinue AI-powered features at any time.

10. Service availability

We aim to keep plexiqa available, stable, and useful, but we do not guarantee that the service will always operate without interruptions, errors, or downtime.

We may:

update and modify plexiqa;
add, change, or remove features;
perform maintenance;
temporarily restrict access to all or part of the service.

Where reasonably possible, we will try to act fairly and take users' interests into account, but some changes or interruptions may occur without prior notice.

11. Paid access, withdrawal, and refunds

Some Plexiqa features may be offered as paid digital access, such as access to exam practice modules, the listening practice section, or other paid learning features. Paid access, its price, taxes, duration, and main conditions are shown before purchase.

Payments are processed by Stripe or another payment provider shown during checkout. We do not store full card details.

Unless otherwise stated at checkout, paid learning access is provided as digital access shortly after a successful payment. By purchasing paid digital access and starting to use it, you request that access begins before the end of any statutory withdrawal period that may apply.

Refunds may be available before you start using the paid access. After paid learning access has been activated or you have started using it, refunds are usually not provided, except where required by applicable law or where the service is unavailable, defective, or not as described.

To request a refund or make a complaint about paid access, contact support@plexiqa.com from the email address connected to your account and include the relevant payment or checkout details and a short description of the issue. We will review requests individually and respond within a reasonable time.

Nothing in this section limits any mandatory consumer rights that apply to you.

12. Third-party services

plexiqa may use third-party services and integrations, including for authentication, hosting, analytics, error monitoring, email delivery, and AI-powered functionality.

Use of such components may be subject to the policies and terms of the relevant third-party providers.

We are not responsible for the content, policies, or practices of third-party services, except as required by applicable law.

13. Limitation of liability

To the maximum extent permitted by law, plexiqa is provided on an "as is" and "as available" basis.

We do not guarantee that:

the service will meet all of your expectations;
the service will always be available without interruption;
the service will be entirely error-free;
any content or output, including AI-generated output, will always be accurate, complete, or fit for a particular purpose.

To the maximum extent permitted by law, we are not liable for:

indirect, incidental, special, or consequential damages;
loss of data, profit, business opportunity, goodwill, or expected benefits;
consequences resulting from your use of, or inability to use, plexiqa;
decisions you make based on AI-generated outputs, recommendations, or learning content.

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law.

14. Suspension and termination

You may stop using plexiqa at any time.

If you want to request deletion of your account, you may contact support at: support@plexiqa.com

We may temporarily restrict, suspend, or terminate your access to plexiqa, in whole or in part, if:

you violate these Terms;
your conduct creates risks for security, infrastructure, or other users;
your use of the service appears abusive;
we are required to do so by law or binding order of a competent authority.

Where reasonable and possible, we may try to notify you in advance or explain the reason for such restriction.

15. Changes to the service and these Terms

We may change plexiqa and update these Terms from time to time.

If the changes are material, we will try to notify you in an appropriate way, for example through the service interface or by email.

Your continued use of plexiqa after updated Terms take effect means that you accept those changes, unless applicable law requires otherwise.

16. Governing law and disputes

These Terms are governed by the laws of Poland, unless mandatory consumer protection rules under applicable law require otherwise.

Any disputes related to the use of plexiqa will be resolved in accordance with applicable law and the relevant rules of jurisdiction.

If you are a consumer, nothing in these Terms deprives you of rights granted by mandatory laws of your country of habitual residence where such laws apply.

Your use of plexiqa is also subject to:

the Privacy Policy;
any other policies or rules expressly referenced in the service.

If there is any conflict between these Terms and the Privacy Policy regarding personal data processing, the Privacy Policy will govern that issue.
